Terms of Service

1. General provisions

1.1. These Terms of Service govern the use of Facey.pl (the "Service"), available at facey.pl.

1.2. The owner and operator of the Service is Daniel Rolley, based at Al. Jerozolimskie 151, Warsaw, Poland (the "Operator").

1.3. Using the Service constitutes acceptance of these Terms of Service and the Privacy Policy.

1.4. The Service enables generating modified images and videos using artificial intelligence (AI face swap and motion control).

2. Terms of use

2.1. The Service is available to individuals aged 18 or older, or legal entities.

2.2. Account registration requires an email address or signing in via Google OAuth.

2.3. The User agrees to:

• Provide truthful information during registration
• Use the Service in compliance with applicable law
• Not upload content that violates third-party rights
• Obtain consent from individuals whose likeness is being processed

3. Likeness and consent

3.1. The User represents that they have the right to use the likeness of all individuals visible in uploaded photos and videos.

3.2. When using the likeness of third parties, the User must have their explicit, written consent for processing by the Service.

3.3. The Operator is not responsible for violations of third-party likeness rights by the User.

3.4. Uploading content depicting minors is prohibited.

3.5. Creating pornographic, violent, fraudulent (deepfake for deception), or dignity-violating content is prohibited.

4. Credits and payments

4.1. Using generation features requires credits.

4.2. Credits can be purchased in packages (prices may change):

• Try: 30 credits — 14.99 PLN
• Starter: 120 credits — 39.99 PLN
• Pro: 300 credits — 79.99 PLN

4.3. Current pricing is always available on the homepage in the Pricing section.

4.4. Generation costs:

• Person swap (AI face swap): 10 credits
• Video generation up to 5s: 10 credits
• Video generation 6-10s: 15 credits
• Video generation 11-15s: 20 credits
• Video generation 16-20s: 25 credits
• Video generation 21-30s: 35 credits

4.5. Credits do not expire and are non-refundable after use.

4.6. In case of a generation error (AI system failure), credits are automatically refunded to the User's account.

4.7. Payments are processed by Stripe. The Operator does not store payment card data.

5. Intellectual property

5.1. The User retains rights to uploaded source materials (photos, videos).

5.2. Generated materials (modified images and videos) belong to the User, subject to Section 3 (likeness rights).

5.3. The Operator does not acquire rights to User materials and does not use them for marketing without consent.

5.4. The source code, design, and architecture of the Service are the property of the Operator and are protected by copyright.

6. Liability

6.1. The Operator makes reasonable efforts to ensure proper functioning of the Service but does not guarantee uninterrupted availability.

6.2. The Operator is not responsible for the quality of generated materials — results depend on source material quality and AI model capabilities.

6.3. The Operator is not responsible for how the User uses generated materials.

6.4. The User bears full responsibility for the legal use of generated materials.

7. Account and data deletion

7.1. The User may delete their account at any time in Settings.

7.2. Account deletion permanently removes: personal data, generation history, uploaded files, and credit balance.

7.3. Unused credits are non-refundable upon account deletion.

7.4. The Operator reserves the right to suspend or delete accounts that violate these Terms.

8. Complaints

8.1. Complaints can be submitted by email to: kontakt@facey.pl.

8.2. A complaint should include: user data, description of the issue, and generation ID (available in history).

8.3. The Operator processes complaints within 14 business days.

9. Right of withdrawal

9.1. In accordance with applicable consumer protection law, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, if the performance has begun with the consumer's express consent.

9.2. By purchasing credits and starting generation, the User consents to the commencement of digital service delivery and acknowledges the loss of the right of withdrawal.

10. Final provisions

10.1. The Operator reserves the right to amend these Terms. Users will be notified by email 14 days in advance.

10.2. Matters not covered by these Terms are governed by Polish law.

10.3. Disputes shall be resolved by the court having jurisdiction over the Operator's registered office.

10.4. These Terms come into effect on March 23, 2026.
